Chapter 11

NICKED IN THE NICK OF TIME

Sophie put in a call to the president of the State Pathology Society, Dr. Williams. The office was closed, so she called his cell phone. She paced her hotel room as the phone rang and rang, then went to voicemail.

“Doctor Williams, this is Sophie Cadeaux. I know it’s late and a weekend, but please call me as soon as possible. It’s concerning the PT test and it’s critical that you get back to me. I just got out of a meeting with Doctor Fantouche from the state lab and government officials. The regulators are going back on their promises to us!”

She hung up, shaking, then ran to the elevator and banged on the buttons with her fist. She headed down to the hotel lounge to brainstorm with Dr. Collins. The Beatles song “Help” was playing.

How appropriate.

Dr. Collins was already there, swirling a gin and tonic. He glanced up as Sophie sat down looking like an injured and defeated athlete at the end of a game lost. The tension was evident in her shoulders.

Sophie rubbed her aching neck. “Art, how can they be stopped? This whole thing is turning out to be a disaster! We on the board of the State Pathology Society thought we were heading off a problem, but it looks like we just created another one. We tried to be proactive and it backfired. What can we do now?”

Art leaned an elbow on the table and rubbed his chin with forefinger and thumb, thinking. He was, after all, a military man with strategic training.

After what seemed to Sophie to be a painfully long time, he looked at Sophie and asked, “Does the State Pathology Society have any kind of contract with the state lab? If so, what does it say?”

“I don’t remember all the details, but I do remember that our legal team inserted some legalese to protect us... something about who owned the slides we contributed to the program.”

“Do you have a copy of the contract?”

“I do on my laptop.”

“Let’s go have a look at it.”

They went up to Sophie’s hotel room. Sophie got her laptop out on the desk and booted it up.

Art read out loud as he looked over Sophie’s shoulder. “‘Since the slides are from patients who have already had follow-up and, if needed, appropriate treatment, it is unlikely that the slides would ever be needed again. However, we want to make it clear that the slides are patient care diagnostic materials, and that the participating labs donating the slides retain complete ownership of the slides. The Pap slides are loaned to the pilot program and can be recalled by the laboratories at any time and for any reason.’”

Sophie suddenly swiveled the chair around as she pointed back to the computer screen.

“That’s it, Art! We can recall our slides at any time... all of us, and all the slides!”

Art had a big grin on his face. “No glass slides, no program! Your legal counsel was wise to put that clause in the contract.
